Terms of Service

1. The Service

EncoreSpot is an online software service that helps musicians, bands, and artist teams create, edit, preview, publish, and host electronic press kits. By accessing or using EncoreSpot, you agree to these Terms of Service.

2. Accounts

You are responsible for keeping your account secure and for all activity under your account. You must provide accurate information and may not impersonate another person, artist, business, or rights holder.

3. Plans, Billing, and Delivery

EncoreSpot offers a free plan and a paid Pro plan. The free plan lets you build and privately preview an EPK. The Pro plan unlocks public publishing, additional press photos, analytics, and priority support. Paid access is delivered digitally through your account immediately after a successful checkout and payment confirmation.

Pro is available as a monthly or annual subscription. Prices are shown on the pricing page before checkout. Unless canceled, paid subscriptions renew automatically at the selected billing interval. Taxes may be added at checkout where required.

4. Payments Through Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle.com Market Limited or Paddle.com Inc., depending on your location, may appear on your receipt or card statement.

Your payment information is submitted directly to Paddle and is not stored by EncoreSpot. Paddle's checkout may show its own terms, privacy notice, and buyer support information.

5. Cancellation

You may cancel your Pro subscription at any time. Cancellation stops future renewals, but does not automatically refund payments already made. After cancellation, Pro access remains available until the end of the paid billing period. Your account data may remain available in draft form, but public publishing requires active Pro access.

6. Refunds

Refund requests are handled according to our Refund Policy. Please review the policy before purchasing. You can request help by emailing support@encorespot.com.

7. Your Content and Rights

You retain ownership of the text, images, music links, videos, press quotes, logos, and other content you upload or enter. You confirm that you have the rights needed to use and publish that content. By publishing an EPK, you grant EncoreSpot a limited, non-exclusive license to host, display, transmit, and format your content solely to provide the service.

8. Acceptable Use

You may not use EncoreSpot to publish illegal, infringing, misleading, abusive, hateful, explicit, malicious, or spam content. You may not attempt to disrupt the service, bypass security controls, scrape private data, or use the service to misrepresent another person or artist. We may remove content or suspend accounts that violate these terms.

9. Availability and Changes

We aim to keep EncoreSpotreliable, but the service is provided on an "as is" and "as available" basis. We may update, improve, suspend, or discontinue parts of the service when needed. We will try to avoid unnecessary disruption to paid users.

10. Limitation of Liability

To the maximum extent permitted by law, EncoreSpot is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost opportunities, lost data, or third-party claims arising from your use of the service.
